Senior Counsel Monte Schatz presented at the ACTEC 2022 MoKanNeb Meeting on December 3, 2022 in Kansas City, Missouri. Mr. Schatz addressed the analysis of the Nebraska Supreme Court decision in Chrisp v. Chrisp (In re: Estate of Chrisp), and its impact on the definition of the augmented estate and the elective share. His presentation provided an overview in light of the Chrisp decision of conflicting provisions between the Uniform Probate Code and Uniform Trust Code as adopted by statute in Nebraska, Missouri and Kansas, including the potential impact of Chrisp as precedent for premarital trusts being included or excluded in the augmented estate, and whether this is consistent with the policy of providing for the surviving spouse through the elective share.
