John Walker is a partner in the Firm’s Litigation Department. His practice spans a broad spectrum, representing individuals and corporations in creditors’ rights disputes, commercial matters, environmental, occupational and safety litigation. In his years of practice, he has handled a wide range of commercial and insurance defense matters, including breach of contract, and representation of a major railroad in many litigation areas.
Mr. Walker is admitted to practice in Nebraska State and Federal Courts. In addition, he has been admitted to practice on a pro hac vice basis in West Virginia, Iowa, Florida, Texas and California.
Denise Destache is a partner of Lamson Dugan and Murray, and has been with the firm since 2004. With a background in both nursing and the law, her primary practice areas include medical malpractice defense and health care law.
Ms. Destache represents health care professionals and health care facilities in medical malpractice cases and state licensure actions. She has advised health care providers in a variety of health law related issues including HIPAA, EMTALA, Peer Review and Quality Assurance activities, and many aspects of health care risk management. She has given numerous presentations regarding these issues to physicians, nurses, facility administrators and risk managers; and has been a guest lecturer for medical, dental, and nursing students. In 2011, Ms. Destache was instrumental in bringing about changes to Nebraska’s peer review and quality assurance laws, which now provide greater protection to these activities which promote a higher quality of health care.
Dave Schmitt is a partner of Lamson, Dugan & Murray, LLP. He represents and advises railroads, trucking companies, health care providers, accounting firms, businesses and individuals in a broad spectrum of legal matters including railroad defense litigation under the Federal Employers’ Liability Act, business disputes, cyber law, contracts, insurance law, tort litigation, and general matters. Mr. Schmitt’s work has resulted in numerous jury verdicts and appellate court decisions in favor of the clients he represents.
Prior to joining the firm, Mr. Schmitt served as a Federal Judicial Law Clerk to the Honorable Lyle E. Strom, Chief Judge of the United States District Court for the District of Nebraska. He has also served as an Adjunct Professor at Creighton University School of Law teaching courses in Trial Practice and Legal Research and Writing.
Dan Chesire is a founding partner of Lamson, Dugan and Murray. He has over 40 years of courtroom experience in defense of personal injury claims and product liability claims. Mr. Chesire’s practice also encompasses general liability claims, insurance coverage issues, and defense of attorneys and healthcare professionals.
Mr. Chesire practices in the Federal Courts in Nebraska and the United States Court of Appeals for the Eighth Circuit. In addition, he has been admitted in Iowa and Illinois on a pro hac vice basis. He has tried product liability cases in Iowa.
Cathy Trent-Vilim is a partner of Lamson, Dugan & Murray. Throughout her years of practice, Ms. Trent-Vilim has worked on a wide range of commercial and insurance matters, including personal injury insurance defense, coverage claims, contract claims, crop insurance claims, legal malpractice, appellate practice and complex commercial litigation. She has tried cases in the Nebraska county, district and federal courts, in arbitration proceedings, and has successfully argued cases before the Nebraska Court of Appeals and Supreme Court.
Brian Brislen is a partner in Lamson, Dugan and Murray’s Litigation Department, where he focuses his practice on corporate, business and commercial litigation. He also has practiced extensively in the area of tort liability claims and regulatory/administrative law. His experience includes trying jury and non-jury matters on the state, federal and administrative levels. He also works with clients in formal and informal alternative dispute resolution proceedings.
Mr. Brislen currently serves as an adjunct faculty member for Creighton University School of Law. Every fall semester since 2006, he has co-taught a trial practice class to a team of four third year law students who ultimately compete in a national trial competition. His teams have advanced to later rounds and received awards for their efforts. He also has taught Legal Writing and Lawyering Skills to first and second year law students at Creighton’s law school. He regularly judges local and regional mock trial and appellate advocacy competitions for law students and high school mock-trial competitions.
Mr. Brislen is admitted to practice in Nebraska State and Federal Courts, the United States District Court for the District of Colorado, the United States Court of Appeals for the Eighth Circuit and the United States Supreme Court.
Anne Marie O’Brien is a partner of Lamson, Dugan and Murray and a member of the Firm’s Litigation Department. Her practice involves a multitude of disciplines, in both tort and commercial practice areas, including commercial tort and business litigation, insurance coverage disputes, and contract and lease negotiation for commercial, insurance, railroad and transportation clients. She has experience in personal injury defense, FELA, products liability litigation, grade crossing, insurance coverage and subrogation litigation, transportation defense work, and contract negotiation, including general civil litigation. Ms. O’Brien has lectured and advised on litigation, insurance and subrogation issues to both defense and plaintiff’s bar associations.
